Ramesh Sharma\, resident of Village Nandpur\, Tehsil Devgarh\, District Pratapgarh\, filed a petition under Section 9 of the Hindu Marriage Act\, 1955 before the Family Court seeking restitution of conjugal rights against her husband\, Arjun Sharma\, son of Sh. Mahender Sharma\, resident of H.No. 215/18\, Shanti Nagar\, Suryanagar\, presently posted as Upper Division Clerk (UDC) at a Government Ordnance Factory situated in Rajgarh\, Uttar Pradesh. \nThe marriage between Priya Sharma and Arjun Sharma was solemnized on 14.12.2015 according to Hindu rites and ceremonies at Village Nandpur\, Tehsil Devgarh\, District Pratapgarh. According to Priya\, her parents spent more than Rs. 20\,00\,000/- on the marriage and gave dowry articles beyond their financial capacity. \nAfter marriage\, the parties started residing together as husband and wife. Out of the said wedlock\, a male child namely Aarav Sharma was born\, who is presently residing with Priya. \nAccording to Priya\, after a few days of marriage\, Arjun\, his father and younger brother started harassing her and repeatedly demanding money from her parental family. She alleges that she kept arranging money from her parents in order to save her matrimonial life. According to her\, despite fulfilling such demands\, Arjun continued to taunt her by saying that being a Government employee he could have married into a wealthier family and received substantial dowry. Priya further alleges that Arjun and his father mortgaged her jewellery without her consent and appropriated the money received therefrom. \nIn January 2023\, Priya shifted to Rajgarh\, Uttar Pradesh\, where Arjun was residing in a Government quarter. According to Priya\, the harassment and demands for money intensified after shifting there. She alleges that in March 2025 she paid Rs.1\,50\,000/- in cash to Arjun. She further alleges that Arjun fraudulently withdrew Rs.50\,000/- from her savings account maintained at a Post Office in Village Nandpur without her knowledge or consent. \nPriya further states that she overheard Arjun and his cousin Rohit Sharma discussing a conspiracy against her. According to her\, on 22.07.2025\, Rohit Sharma forcibly entered her Government quarter and attempted to outrage her modesty. She alleges that when she raised an alarm and informed Arjun about the incident\, he sided with Rohit and told her that she would have to keep both of them happy if she wished to continue residing in the matrimonial home. \nAccording to Priya\, when she refused\, Arjun physically assaulted her. Thereafter\, Priya informed her family members\, who travelled from Village Nandpur to Rajgarh. She alleges that even in their presence\, Arjun demanded Rs.10\,00\,000/- in cash for purchase of a car and threatened that unless the demand was fulfilled\, she and her son would not be allowed to stay in the matrimonial home. Upon refusal by her family members\, Priya alleges that she and her minor son were forcibly turned out of the matrimonial home and threatened with dire consequences. She further alleges that her istridhan was retained by Arjun. \nDespite the aforesaid incidents\, Priya claims that she is willing and ready to resume cohabitation and discharge all matrimonial obligations. She contends that Arjun has withdrawn from her society without reasonable cause and therefore seeks a decree for restitution of conjugal rights under Section 9 of the Hindu Marriage Act\, 1955. \n  \nVERSION OF THE RESPONDENT-HUSBAND \nArjun Sharma disputes all allegations made by Priya and claims that the petition is false\, fabricated and filed after concealment of material facts. \nAccording to Arjun\, Rohit Sharma is the son of his maternal uncle and had come to Rajgarh to visit him on 22.07.2025. Arjun states that he left for office in the morning and returned to his Government quarter at around 9:40 A.M. after realizing that he had forgotten his lunch box at home. Upon entering the quarter\, he allegedly found Priya and Rohit in a highly objectionable and intimate position under circumstances suggestive of an illicit relationship. \nArjun claims that he was mentally devastated and immediately informed both families about the incident. He further claims that he lodged a complaint before the local police authorities and subsequently initiated legal proceedings seeking further investigation\, which are stated to be pending before a competent court. \nArjun contends that neither he nor his family members ever demanded dowry\, cash or valuable articles from Priya or her family. He further denies allegations regarding withdrawal of money\, misappropriation of jewellery\, physical assault and forcible eviction from the matrimonial home. According to him\, Priya voluntarily left the matrimonial home and is suppressing material facts before the Court. \n  \nTASK \nParticipants are required to assume the role of Counsel for the Respondent-Husband\, Arjun Sharma\, and draft a comprehensive Written Statement/Reply to the petition filed under Section 9 of the Hindu Marriage Act\, 1955. \nThe Written Statement should include: \n\nPreliminary Objections;\nPara-wise Reply to the Petition;\nAdditional Pleas and Defences;\nPrayer Clause.\n\nParticipants may raise all factual and legal objections available to the Respondent on the basis of the facts provided above. \n  \nSUBMISSION GUIDELINES \n\nLanguage: English only\nFormat:\n\nFont: Times New Roman\nSize: 12 (Text)\, 14 (Headings)\, Line Spacing: 1.5\nWord Limit: 2000–5000 words only\nFile Format: PDF only\n\n\nSubmission Mode: Email to events.vidhiparivartan@gmail.com with subject line: “NLDC 2026 Submission – [Your Name]”\nFile Name:  [Your Full Name].pdf\nOriginal Work Only: Plagiarism beyond 10% will lead to disqualification\nDeclaration: Add a self-declaration of originality at the end of the document\nOnly one submission per author(s) will be accepted. Her throat had been slit\, and there were signs of blunt-force trauma. The family’s domestic help\, Hemant Rawal\, who had been missing since that morning\, was initially suspected of the murder. \nHowever\, the very next day\, Hemant Rawal’s decomposed body was found on the terrace of the same house — also with a slit throat and head injuries. This shocking revelation redirected suspicion toward Sanya’s parents\, Dr. Ritesh Mehra and Dr. Kavita Mehra\, both reputed dentists owning a prominent dental clinic in the city. \nInvestigation: \n\nThe local police\, followed by the Central Bureau of Investigation (CBI)\, investigated the matter in two phases.\nThe first investigative team concluded that the parents had committed the murders\, alleging that Dr. Ritesh found Sanya and Hemant in an “objectionable position” and\, in a fit of anger\, killed them both.\nHowever\, due to inconclusive forensic evidence\, contradictory statements\, and no eyewitnesses\, the case was reassigned to another CBI team.\nThe second team found insufficient evidence against the parents and filed a closure report\, stating that the case remained “unsolved.”\nThe Magistrate rejected the closure report\, took cognizance\, and summoned the parents to face trial.\n\nTrial Court’s Findings: \n\nThe Trial Court convicted both Dr. Ritesh and Dr. Kavita under Sections 302 (Murder)\, 201 (Destruction of Evidence)\, and 203 (Giving False Information) of the Indian Penal Code.\nThe Court relied heavily on circumstantial evidence\, including the “last seen” theory\, alleged tampering of the crime scene\, and inconsistencies in the accused’s statements.\nBoth were sentenced to life imprisonment.\n\nAppeal: \nThe accused have appealed before the High Court of Pravaas\, contending that: \n\nThe conviction is based on suspicion and conjecture\, not proof beyond reasonable doubt.\nThe prosecution failed to establish motive or a complete chain of circumstances.\nMishandling of evidence and a media trial violated their right to a fair trial under Article 21 of the Constitution.\n\nThe State\, on the other hand\, argues that: \n\nThe accused were the only adults present in a locked house\, and thus\, under Section 106 of the Indian Evidence Act\, the burden of explaining the deaths lay upon them.\nThe circumstantial chain is complete\, proving their guilt beyond reasonable doubt.\nThe accused’s conduct after the incident and their inconsistent statements reinforce their culpability.\n\nIssues for Adjudication: \n\nWhether the prosecution has established the guilt of the accused beyond reasonable doubt through circumstantial evidence.\nWhether the Trial Court erred in shifting the burden of proof under Section 106 of the Indian Evidence Act.\nWhether media interference and public perception compromised the fairness of the investigation and trial.\nWhether the conviction and sentence passed by the Trial Court are sustainable in law.\n\nInstructions for Participants: \nParticipants shall write a reasoned judgment as if they are Hon’ble Judges of the High Court of Pravaas. \nThe judgment must include: \n\nBrief Statement of Facts\nIssues for Determination\nArguments by Prosecution and Defence (summarized)\nJudicial Reasoning and Analysis\nFinal Decision and Justification\nWord Limit: 2500–3000 words.\n\nParticipants are encouraged to refer to constitutional principles\, judicial precedents\, and evidentiary law where relevant. \n Disclaimer: \nThis proposition is a purely fictional academic exercise inspired by legal and investigative themes for the purpose of educational and analytical learning. \nAll characters\, names\, and incidents are fictitious\, and any resemblance to actual persons\, living or deceased\, or to any real events is purely coincidental. \nThis material is not intended to hurt or offend the sentiments of any individual\, institution\, or community. \nREGISTRATION FEES \n\nSingle Author: Rs. 300/-\nCo-Authorship (Maximum 2 authors): Rs. 500/-\n\nThe registration fee can be transferred to Ms. Nancy Garg via UPI or Googlepay at 8168515340. \n  \nMODE OF REGISTRATION \nParticipants are required to fill in the Google form link provided below for the purpose of registration.
