DRAFTINGÂ PROPOSITIONÂ
Priya Sharma (aged 33 years), daughter of Sh. Ramesh Sharma, resident of Village Nandpur, Tehsil Devgarh, District Pratapgarh, filed a petition under Section 9 of the Hindu Marriage Act, 1955 before the Family Court seeking restitution of conjugal rights against her husband, Arjun Sharma, son of Sh. Mahender Sharma, resident of H.No. 215/18, Shanti Nagar, Suryanagar, presently posted as Upper Division Clerk (UDC) at a Government Ordnance Factory situated in Rajgarh, Uttar Pradesh.
The marriage between Priya Sharma and Arjun Sharma was solemnized on 14.12.2015 according to Hindu rites and ceremonies at Village Nandpur, Tehsil Devgarh, District Pratapgarh. According to Priya, her parents spent more than Rs. 20,00,000/- on the marriage and gave dowry articles beyond their financial capacity.
After marriage, the parties started residing together as husband and wife. Out of the said wedlock, a male child namely Aarav Sharma was born, who is presently residing with Priya.
According to Priya, after a few days of marriage, Arjun, his father and younger brother started harassing her and repeatedly demanding money from her parental family. She alleges that she kept arranging money from her parents in order to save her matrimonial life. According to her, despite fulfilling such demands, Arjun continued to taunt her by saying that being a Government employee he could have married into a wealthier family and received substantial dowry. Priya further alleges that Arjun and his father mortgaged her jewellery without her consent and appropriated the money received therefrom.
In January 2023, Priya shifted to Rajgarh, Uttar Pradesh, where Arjun was residing in a Government quarter. According to Priya, the harassment and demands for money intensified after shifting there. She alleges that in March 2025 she paid Rs.1,50,000/- in cash to Arjun. She further alleges that Arjun fraudulently withdrew Rs.50,000/- from her savings account maintained at a Post Office in Village Nandpur without her knowledge or consent.
Priya further states that she overheard Arjun and his cousin Rohit Sharma discussing a conspiracy against her. According to her, on 22.07.2025, Rohit Sharma forcibly entered her Government quarter and attempted to outrage her modesty. She alleges that when she raised an alarm and informed Arjun about the incident, he sided with Rohit and told her that she would have to keep both of them happy if she wished to continue residing in the matrimonial home.
According to Priya, when she refused, Arjun physically assaulted her. Thereafter, Priya informed her family members, who travelled from Village Nandpur to Rajgarh. She alleges that even in their presence, Arjun demanded Rs.10,00,000/- in cash for purchase of a car and threatened that unless the demand was fulfilled, she and her son would not be allowed to stay in the matrimonial home. Upon refusal by her family members, Priya alleges that she and her minor son were forcibly turned out of the matrimonial home and threatened with dire consequences. She further alleges that her istridhan was retained by Arjun.
Despite the aforesaid incidents, Priya claims that she is willing and ready to resume cohabitation and discharge all matrimonial obligations. She contends that Arjun has withdrawn from her society without reasonable cause and therefore seeks a decree for restitution of conjugal rights under Section 9 of the Hindu Marriage Act, 1955.
VERSION OF THE RESPONDENT-HUSBAND
Arjun Sharma disputes all allegations made by Priya and claims that the petition is false, fabricated and filed after concealment of material facts.
According to Arjun, Rohit Sharma is the son of his maternal uncle and had come to Rajgarh to visit him on 22.07.2025. Arjun states that he left for office in the morning and returned to his Government quarter at around 9:40 A.M. after realizing that he had forgotten his lunch box at home. Upon entering the quarter, he allegedly found Priya and Rohit in a highly objectionable and intimate position under circumstances suggestive of an illicit relationship.
Arjun claims that he was mentally devastated and immediately informed both families about the incident. He further claims that he lodged a complaint before the local police authorities and subsequently initiated legal proceedings seeking further investigation, which are stated to be pending before a competent court.
Arjun contends that neither he nor his family members ever demanded dowry, cash or valuable articles from Priya or her family. He further denies allegations regarding withdrawal of money, misappropriation of jewellery, physical assault and forcible eviction from the matrimonial home. According to him, Priya voluntarily left the matrimonial home and is suppressing material facts before the Court.

Court: High Court of Pravaas (Appellate Jurisdiction)
Background Facts:
On the morning of 16th May 2018, the body of Sanya Mehra, a 14-year-old girl, was discovered in her bedroom in her familyâs apartment in Noidu, Pravaas. Her throat had been slit, and there were signs of blunt-force trauma. The familyâs domestic help, Hemant Rawal, who had been missing since that morning, was initially suspected of the murder.
However, the very next day, Hemant Rawalâs decomposed body was found on the terrace of the same house â also with a slit throat and head injuries. This shocking revelation redirected suspicion toward Sanyaâs parents, Dr. Ritesh Mehra and Dr. Kavita Mehra, both reputed dentists owning a prominent dental clinic in the city.
